Part of the Safe Harbor provision which is what allows YouTube to basically still exist given all the copyright infringement that goes on there, requires that they have an automatic takedown procedure, which occurs expeditiously. In other words, if someone with even the barest of claims, claims infringement YouTube must take down. YouTube doesn't exist to fight copyright battles. <br /><br />The 'infringing party' then gets to fight it. A process which can get both messy and costly. In this instance, the Fine Bros probably have a strong argument under the parody defense. If they want to fight it they have a good argument. YouTube really had no option here if Summit made a claim. <br /><br />The real question is not whether or not it infringed but what motivated Summit to make such a move.
