I had some initial reactions last night about this post but decided to hold off until today so I could read the TOS with fresh eyes. Now that I've done that my first reactions have only been reinforced.

The biggest problem I see is that UVCs (User Video Creator as defined by the TOS) have control of their original work is they have "original" status but not if they have "derivative" status. First thing that pops out at me is the defintion of intellectual property.

"TOS wrote:Derivative Videos are videos that are derivative works of the intellectual property owned by lonelygirl15 and relating to the lonelygirl15 Series, Kate, or other Series Spin-Offs, including, but not limited to, ideas, characters, symbols, storylines, images, music, sounds, or video from the Series, Kate, or other Series Spin-Offs ("lonelygirl15 Intellectual Property")."

So what doesn't that cover? Let's say I make a video of a guy staking out a female teenager's house and suggest he is a watcher. Is that derivative? What if the girl turns out to be a vampire slayer? I mean who really is being derivative of who? Let's take Dr. Immant. Dr. Immant has a symbol at the end of his videos that represents the Order he represents. The symbol represents the unique history of the Order. The symbol can also be interpreted as representing a faction of the lg15 universe Order. It's no skin off my back to reveal that history, give a unique name to the Immant Universe Order and claim original status. Anyone else who hasn't used specific lg15 references can use the same method to sanitize their work of lg15 elements.

"TOS wrote:lonelygirl15 hereby grants all Registered Users a worldwide, non-exclusive, royalty free, irrevocable license to make Derivative Videos using the lonelygirl15 Intellectual Property on the following conditions: 1) the Derivative Video is created and distributed for non-commercial purposes; 2) the Derivative Video is uploaded or submitted to the Website; 3) a link to the Website is included wherever and whenever a Derivative Video is distributed, posted, submitted, or uploaded anywhere other than the Website; and 4) other people can make their own Derivative Videos from your Derivative Video under the same terms and conditions as this license."

For the life of me I do not understand the logic of allowing this! First off, lonelygirl15 is allowing use of their IP for a number of reasons but to sum it up, however small or large-they get something out of it. What do UVCs of derivative works get when someone else uses their IP? The way I see it this encourages people to take short cuts and take advantage of others hard work and creativity.

Under this rule someone can create a Facility F (for FUBAR) adopt the look and feel of Facility J, attribute it back to FacilityJ through a link which will only give the appearance that FacilityJ is behind it and then proceed to either intentionally or unintentionally introduce something that doesn't make sense, reveal something that isn't what FacilityJ had planned or just do any of a number of things that would only hurt what Facility J has established.

The Flock was something written on the white board. I recognize that it represents the religious members of the Hymn of One and that is lg15 IP. Anyone can do a story about members of the Flock. Anyone can create characters for "new girls" in fact, I'm the one who encouraged that! However, my story revolves around a certain group within the Flock. My characters and that concept should be protected from use by someone else.

I really don't like to talk about this. I think it sets up an unfair expectation. I've done a lot of research on revenue sharing and 1) very few people qualify for it and 2) it's not enough to sustain a production. Anyone who has a revver acct knows that. You guys know that, you put a paypal button on your site.

Unless you have a plan for promoting our vids so that we get tens of thousands of views or brokering product placement deals we shouldn't be talking about monetization- at least not give the impression that it will yield anything more than what people were getting with revver.

I really would have preferred more conversation in the TOS discussion thread.

WHO WAS FRANK?

Blogspot Frank on LGPedia

As part of our retrospective look back at the strange Cassie events of September/October 2006 we have to ask the question "Who was Frank?" According to LGPedia: Blogspot Frank was the first Frank to show within the Breeniverse and is more than likely the direct or indirect source and inspiration for all of the other "Franks". Frank was first alluded to by Cassie on her YouTube Channel page with the phrase "Frank is Waking". Eventually someone found a blog that had a lot of similarities with things that were transpiring in the Cassieiswatching story. Soon this Frank's blog comments were flooded with CiW followers. Many of these posters were exceptionally abusive and there was concern that if this really were some poor schizophrenic guy with a blog he could be pushed over the edge. These fears were alleviated when a code was found in the first letters of the lines of the blog.

Now, on Frank's blog he says he is from AZUSA!

It seems that little Azusa is often mentioned in the same breath with Satanic Ritual Abuse, something which fed greatly wild speculation among Lonelygirl15 fans that the swimming hole would be the site of the ceremony.

I could be wrong here and Im too lazy to figure out how to go back and check, but thats not how I remember it going down. I thought the first mention was somthing about "Frank has been more help than you"... speculation followed about who the hell is frank and then the blog was discovered. The story then goes that Cassie has possessed Frank (?) and he was the one who made th CiW vids (he admitted that it was in his capability- he was a video editor) It wasn't until much later that "Frank is waking" went down. (At least thats how it happened in my head?) Oh how I miss Frank and Cassie.

A New York Times blogger, Virginia Heffernan, who had been extensively covering the story of lonelygirl15, reported on cassieiswatching's first video before it was released in this entry , describing it as "[a] renegade lonelygirl-spinoff, which has some attenuated ties to the original". When asked about it through e-mail, Ms. Heffernan said:

"I was tipped off to it in weird ways: Morse-code text messages, Skype
IMs with a mysterious name, and that screwy audio file. The only
proof that what the person was saying was true is that he/she/they/it
had a photo and the coordinates of the swimming hole, so I believed
that there had been some contact with the original creators. But who
knows?"

My interpretation:

NEW TERMS OF SERVICE

Hey everyone,

We posted the new Terms of Service! We listened to what the community had to say and crafted a Terms of Service that will encourage fan fiction and original videos.

In a nutshell, the Terms of Service allows people to create what we are calling Derivative Videos (videos containing our intellectual property) as long as these videos are 1) non-commercial, 2) uploaded to our site, 3) if they are uploaded to other websites (which we are allowing) they must contain a link back to our website, and 4) other people can make derivative videos from these videos under these same terms.

Basically, this means that if someone creates a new character that is "fighting the order," that person can put the video anywhere they want as long as they also put it on our site, don't make money from the video, put a link in the description when it is uploaded to other sites, and let other people build from that story/character. As we have discussed, we are working on ways to allow people to monetize these Derivative Videos on our site. Give us time for this, it took Google six months!

For original video creators, we are saying that they control their copryights. They own the videos and can assign a creative commons license to the community if they like - it is completely up to them. Also, when they upload the video to our site, they are giving us permission to monetize those videos through banner ads or other advertising on our site. We will not package these videos and make DVD's because our license to "use" these videos terminates when the video is removed from our site.

Hope that solves everything. We have thought long and hard about this issue and only want what is best for the community. Please understand that we are a business and cannot totally relinquish our copyrights or limit our ability to sell advertising space on our website. Ownership of copyrights and selling advertising on our website is the only way we can continue to produce this show and function.

Thank you and we really hope this opens the door to many more great fan videos and original storylines.
