Cyber Bullying Mom Charged in MySpace Suicide Case

"The indictment said that in violation of terms of service, "Drew" and co-conspirators knowingly and agreed with each other to intentionally access a computer used in interstate and foreign commerce without authorization and in excess of authorized access, and by means of an interstate communication, obtain information from that computer to further a tortious act, namely, to intentional infliction of emotion distress.""


TRANSLATION: It was the violation of MySpace TOS that made this a federal crime!!!!!!!

Think twice before you sign up for an online service using a fake name or e-mail address. You could be committing a federal crime.

  1. The legal argument behind this is very interesting and actually appears to have implications for anyone who creates a fictitious MySpace (or other) account.

  2. Yet they promoted the 12 in 12 last year.
    I don't think they would actively seek out imposters unless they did what this person(s) did. To round up and discard all the ficticious names on MySpace would not only be more trouble than it's worth, but it would kill the market. Not many folks use their real names online.
    In fact, using a real name in the context of such an anonymous medium could be quite harmful.
    Either way, I hope this woman really does spend twenty years behind bars for this. What she did was utterly horrible.
