Caution: Fan Video or Copyright Infringement?

A handful of fans have reported receiving notices from Youtube warning that one or more of their posted videos contained copyrighted material from LG15. These notices instructed the channel owner to either delete the video from their account, delete their Youtube account, or allow LG15 to advertise on their video.

These notices appear to be generated from Youtube’s automated Content Verification Program that checks videos that are uploaded to Youtube for copyrighted content. It appears Eqal has enrolled in this program; however, it is unclear what involvement Eqal plays, if any, before the notices are sent. For example, Eqal may have to accept or approve the notices of flagged videos before they are emailed to the owner of the alleged infringing video.

Youtube’s Content Verification Program allows the enroller to choose a preferred usage policy, either to block, track, or monetize the infringing video. Videos that were originally flagged by this program were automatically blocked. However, LG15 has since changed that preference and now allows the video owner a choice.

It is unclear whether these notices are flagging videos whose content is entirely LG15 footage or a montage of clips that include some LG15 footage.

Concerned fans have emailed Eqal, though they have yet to receive a response. However, Amanda Goodfried, one of the Creators, has responded to comments on Inside LG15 suggesting that these notifications are for the most part a misunderstanding.

In any case, every fan should review Youtube’s Terms of Use and Copyright Policy. These notices will not bring legal action. Amanda has commented that Eqal is working with Youtube to find a reasonable solution and has encouraged fans to continue creating their videos.

Hey everyone! Don't fight each other... fight the order. Ok that was lame, but I'm just trying to break the ice. :) All of your videos are important to us. It amazes me how much talent and creativity the LG15 community has...we want the world to see your videos! We certainly don't want any videos or accounts to be deleted. In response to your concerns, we have reached out to youtube and asked them to fix it. We've been told that the settings have been changed and this will no longer happen. Let us know if this continues and we'll speak to them again. Please, keep creating and keep fighting... the order!

    I have seen enough excerpts from other people's notices to know they're form mails and identical to mine.

    THIS POST IS MASSIVELY SLANDEROUS AND FACTUALLY WRONG.

    1. The message does NOT claim copyright infringement - it says "Your video "$VIDEO_NAME" has been identified by YouTube's Content Identification program as containing copyrighted content which lonelygirl15 claims is theirs." and ends with "If you believe that this claim was made in error, or that you are otherwise authorized to use the content at issue, you can dispute this claim with lonelygirl15 and view other options in the Video ID Matches section of your YouTube account."
    So not only does YouTube not claim copyright infringement, but actually tells you what to do and where to go if you want to dispute this claim.
    In fact, YouTube admits here that it cannot determine whether a use is infringement.
    2. Not only does the notice NOT tell you to delete your content, it actually says Your video "$VIDEO_NAME" is still available because lonelygirl15 does not object to this content appearing on YouTube at this time.. Unless they recently changed the form mail, this is a blatant lie in the post.
    3. As readable here (in bold, no less) and here, the process is entirely automated. The Creators set a preferred policy at the end of September, and everything else from there, the identification, the notice, the policy enforcement, are automated. The Creators are not involved in it.
    4. The fucking notice is valid. In case you forgot, you actually are using copyrighted material by the Creators. Yes, you are "licensed" to do so, but the notice doesn't claim any otherwise - you are using LG15 video material, and the notice claims you are using LG15 video material. That's all. Of course that is an unintended side effect, and I know it would be prettier if it hadn't happened - but ultimately, the notice is 100% true. Sure, there's a moment of shock and questions of legal trouble. But since even the post there admits that no legal trouble is coming, the only difference to before is a small ad. While, again, I understand and admit that it's sort of sucky, a tiny ad is sort of a small price to pay for an almost unlimited license. Try doing the same shit we do with LG content with content from the NBC or Universal Pictures. See if they will allow it up with just a tiny ad.
    5. The side note that videos that "were originally flagged by this program were automatically blocked" is the fucking pinnacle of taking things out of context. The sole video I know of that was blocked was mine, and that was entirely unrelated to this situation. It was not a fan video, and I do not, in any way, shape or form complain about the notices I got or the fact that that video was blocked. That was an absolutely legitimate decision, and more importantly, it was reversed within 24 hours. Unless there are other blocked videos I don't know about, this note is a slanderous spin on out-of-the-context facts at best.

    The notices and the ads are an unintended side effect of an automated system that only affected a small circle of users and is being worked on.
    There is no ill intent, no malicious action by the Creators, no nothing. Just the typical Creator-oops. They simply didn't realize that the program wouldn't just find infringement, but all instances of usage. That sucks, but it's a simple mistake, and the worst that happened was that a few people got a true e-mail and a little ad block. They could all have done what the e-mail said and disputed the claim, or they could just have ignored the mail. No harm was done, all videos are still up, the Cs are working on it.

    There is no controversy. And those who create it only show that they don't give a shit about reality and only want to stir up trouble. This post was written in entire disregard of the facts, spinning the few facts that are marginally touched, and LG15 Today should be ashamed for having published this.

    The Creators are not responsible for sending you notices, they do not manually place ads on your videos, no one is getting blocked, and there is no crackdown on fan fic. They have said they're working with YouTube to solve the problem, so just sit back, relax, and notify them if you get a notice.

    Sure, you can complain about the ad, and you can tell them how stupid they are to not have foreseen this - but do not lie about the facts, and do not blame YouTube's actions on the Creators.

Where in the post does it say that youtube claimed "copyright infringement". Now a lot of fans have talked openly in chat about youtube claiming such but the wording of the article seems to be in line with what YouTube actually said. In any case when you threaten your fans that you are going to remove their youtube channel it certainly does not go against the notion that youtube is in fact claiming copyright infringement..... in fact that is the entire idea of the program from what we can understand.

    Perhaps there is a better way of wording it but to claim "MASSIVELY SLANDEROUS" is a pretty big stretch in reality.

I believe the post was just intended to keep people up to date with what is going on but it has been weeks and we have heard nothing from Eqal. We want to reach out to the community and find out if people are still having problems. Thats all.

  7. Gade, I stopped reading your post halfway... Dear god, deal with your cropped up frustrations elsewhere. No matter how true or correct the messages are, the fact is that this issue raised concerns with a lot of people that have LG15 fan videos up.

    A notice that you are using copyrighted material will often look like you're being accused of something. I think the message displays the feelings of ugc makers very well. Unfortunately it looks like you can't deal with feelings well and need fact for everything.

    The tone in your reply is unnecessarily offensive against the poster and the words you choose are far from professional. You talk about slander, but at the same time you call someone, who just displays her genuine concern, a liar and talk in a very aggressive manner towards this person.

    What if you win this battle? Do you feel happy then? Well, congratulations, I'll let you win. Are you proud of yourself?

    - YouTube admits it cannot determine infringement.
    - The mail does not claim infringement.
    - The Creators have said it's an error.

    Infringement is neither an option nor implied.

    The questioning headline is deliberately misleading and panic-inducing.

    I understand that they're pissed. But there's a giant difference between discussing and bitching about the problem, and inventing offenses.

    Aside from half a sentence of the first paragraph, and telling people to read the TOS, basically nothing in this post is actually true. Some of it touches fact, yes. But even that puts a spin on it.

  11. YouTube is saying that the intellectual property bears a similarity to the intellectual property owned by the Creators. I think any reasonable person knows exactly what is being said there and that is the standard used by the law. In the case of many of the videos in question the Creators themselves asked the fans to make the Ninja videos and post them on youtube. Then they authorized YouTube to use a automated program to issue threats against those who entered their contest. Is that fair. Did they make a smart decision. Should it be reversed? Should the Creators apologize to the fans for their "mistake". You be the judge. We are not the ones who created this situation. Eqal and YouTube did and they need to fix if pronto.

We can append it to the original article so it is clear what YouTube actually sent out. However Eqal appears to have agreed to this process and that makes them equally accountable.

  16. model, for one, no threats are being made. You are simply being informed.
    Secondly, as I said before, YouTube both admits it cannot detect infringement as well as tells you what to do to if you want to dispute lg15's claim on the material. The message does not ever imply you infringed on any copyright. It simply notifies you LG15 claims that's their content, and thus gives them an option to handle your use of it.

    Thirdly, I can give you the text of the e-mail for you to post (with the video name removed, it's deleted anyway), under the condition that my initial comment is also added to the post, so there is a balanced view on the front page.

  18. Ren, we are friends, but you have a history of making rather abbrasive, explosive, and rude comments to those who do not share your point of view. As I have said to you before, I respect your opinion; however, I do not respect how you choose to share it. My intention in writing this article was not to stir up drama, slander Eqal, or cause panic. I spoke to several individuals who have received these notifications. I read through Youtubes policies and information regarding the program. I did research. I tried to write an article that showed both side, of those who received the notice in alarm and felt betrayed, and of Amanda's where she said they're working on it. I also tried to respect the privacy of those involved and not go into specifics. I received information from one poster who's been corresponding with YT. They informed this poster that the Copyrighted company may have to approve the flagged video before a notice is sent to the poster. The language I tried to use implied the information we gathered but left room for error. Eqal has not replied to questions. They have not clarified the situation. I wanted the community to know what has been going on, to warn them if they received such a notice, to be aware of YT's policies, and to allow them to draw their own conclusion. For you to accuse me of slander, attack me, and degrade me reflects very poorly on our friendship. I encourage you to find a better way of communicating your opinions, less no one takes you seriously; but more as a raging zealot. You may have good things to say, but you do not say them well.

    If anybody got a different notice than me, fine, I'll back off. But I have six of these and not a single one threatens to remove my account.

    Ever, I have informed you extensively of all the shit above. I have linked you to the same pages, I have directly and clearly told you that I have these notices and they do not allege infringement, that they do not threaten anything and so on.

    You knew everything I said above, you have seen YouTube's official explanation that the process is automated, and so on. You knew what you said was false before you posted it, and you didn't give a shit.

    As for the cheap attempt on an ad hominem, the fact that I have made angry posts in the past does neither prove that any past post of mine, nor that this current post of mine is in any way wrong. It just means that I loudly tell you you fucked up.

    I'm interested to see the notices that claim infringement, that tell users to delete their videos, that threaten to delete their accounts.
    I am interested in seeing the official YouTube page that says that copyright holders are actively involved in the identification, notification, and reaction process.
    I am interested in knowing of a single person, who, in the context of the supposed "crackdown on fan fic" had his or her video blocked.

    I am interested in seeing a single piece of evidence that shows that anything you said up there is in any way, shape or form marginally true.

  22. Ren, you have the e-mail but yet you do not post it. To me that suggest you have an alterior motive here.

    Blogger also sends out similar notices and I know that in that case they will remove an offending account if the situation is not corrected. That is pretty standard practice. Now blogger is google and not youtube but I would be interested in knowing what youtube would do if you ignored their claim. I would be extremely surprised if removal of the account is not the top option and in fact in other cases of repeat offenses youtube has done just that.

    We all want the accurate facts here but your reluctance to provide documentation makes it very difficult.

    The bottom line here is that Eqal is accountable for all this and they need to communicate with fans and let us all know what is going on. In the absence of their participation in the dialogue all we have is supposition.

    You are the ones publicly claiming YouTube alleges copyright infringement.
    You are the ones publicly claiming YouTube instructed people to delete their videos, among other things.
    You are the ones publicly claiming YouTube threatened to remove accounts as a reaction to that incident.
    You are the ones publicly claiming Eqal may have to accept or approve in order to send notices, while I have already proven doubly that YouTube officially advertises that the program is entirely automated.
    You are the ones publicly claiming YouTube is offering users a choice about the action taken.
    You are the ones publicly claiming YouTube blocked a video as part of this "crackdown on fan fic".

    You are the ones making the claims, you are the ones who have to prove them.
    I will gladly show you my side of things if you actually manage to fabricate something - but so far, all I see is LG15 Today making a wide array of claims about these notices, supposed actions, and supposed involvement of the Creators without a single piece of evidence.

    Yes, I have notices of this kind, and I will gladly share them. But I am not the one making the original claim, so I am not the one who has to show first.
    What the hell kind of system is that supposed to be? You claim something, and I have to prove you're wrong? You have to show prove you're right in the first place!

    Everybody else in this discussion has screamed I should calm down, be civil, whatever.
    In a normal, calm, rational discussion, the burden of proof lies with the one making a claim. Your original claims are listed above. I am waiting for your proof to back them. Once the first set of claims has a set of evidence, we can gladly move on to the second set of claims, mine, and I will provide my evidence.


    You are the one to lament an unwillingness to provide proof? I have already provided links to support several of my claims - in other words, I have already provided half my evidence before I even had to, while you have yet to come up with a single piece.

As an appendix for steven_deschain, joe, jenlight, mitch, and anyone else following this discussion.....independent of whether you believe me or not - is it too much ask for actual proof of their claims? Should it not be a question of courtesy for them to release proof of their claims when asked? Is it not ridiculous that there is even a discussion about this? They make some pretty wild claims. I'd like to see some evidence. No matter how angry you think I am, do you really think that's an unreasonable request?

    Given the questions I have raised, would you not want to know, for yourself, whether what they claim is actually true or not?

    Even if it is an automatic function of the partner program Eqal is still accountable to their fans since they authorized the use of said infringing intellectual property.

    What is surprising here is that Eqal posts a lot of fan videos on their web site with equally infringing music and does not seem to have a problem with that. It would seem that this entire problem could just go away if Eqal requested YouTube to turn off the filter on their intellectual property.

While I think a company that makes contests that encourage people to use their intellectual property putting filters on that alert every single person that use their property is ridiculous, I don't think that he is saying that Eqal has no role in this, just that perhaps they are not necessarily the big bad devil the initial article may have made them sound like.

    That being said much would be solved by turning off the filters and/or the Creator's getting back to the fans even if its to say we've entered into this program, its going to put our ads on your pages, don't be alarmed we're not really going to punish you since we relish our fans commitment to our program. Just a thought.

    That is your claim, and I am telling you I have already provided two links that prove this false - YouTube says, on two official pages, that the system is entirely automated. Eqal's only "involvement" in this is enrolling in a content identification program. Whether that was a smart decision or not is entirely independent from the fact that they are not involved in sending out notices to users, contrary to what your blog claims.

    Are you going to post proof for LG15 Today's claims, or are you just going to continue to divert and throw Red Herrings until I stop pointing out you have no evidence at all for what you publish?

  30. To me it does not matter if it is automated or not. The fact is that they agreed to this which makes them totally accountable. But, even if you do not hold Eqal accountable have the asked YouTube to cut it out already?

    I do know that several people have unsubscribed already because they were offended and angry at what Eqal/YouTube is doing. Surely it does not make any sense to continue with this program. Right?

  31. Whether it is economically wise for eqal to alienate their fans in no matter in what way is entirely independent from the fact that LG15 Today evidently broadcasts false allegations and implications on their front page and refuses to correct or clarify them.

    The mistake of underestimating the scope or effect of a problem is not equal to personally send out notices to users, telling them to delete the videos or threatening to delete their accounts.

    Questioning how smart it was to enroll in the content ID program (and I am not saying it was smart at all) is entirely independent from the fact that you are misrepresenting both the actual notice and its message as well as the Creators' involvement in sending it.

    Are you going to post proof for LG15 Today's claims, or are you just going to continue to divert and throw Red Herrings until I stop pointing out you have no evidence at all for what you publish?

  33. I do not think the fact that YouTube has been harassing fans has been disputed. That is the central issue here. A number of fans are extremely mad and some have essentially left the community because of this.

    Once we get the details of what actually happened from Eqal we will be happy to publish their side of the issue. I do not have a copy of the original e-mail so I cannot comment on the accuracy of the post. I requested it from you Ren and so far you have refused to provide it.

    What kinds of usage policies are there?
    There are three usage policies -- Block, Track or Monetize. If a rights owner specifies a Block policy, the video will not be viewable on YouTube. If the rights owner specifies a Track policy, the video will continue to be made available on YouTube and the rights owner will receive information about the video, such as how many views it receives. For a Monetize policy, the video will continue to be available on YouTube and ads will appear in conjunction with the video. The policies can be region-specific, so a content owner can allow a particular piece of material in one country and block the material in another.

  35. From what i remember in chat when this issue came up the topic of account deletions was raised and so at least some fans felt they were being threatened with that. It is quite possible that they did not completely comprehend how the system worked but none the less they did feel that they were being threatened with account deletion. Now perception does not make it legally binding but it does probably form the basis of what was written in the article.

    Eqal has had plenty of time to lay out the facts here and explain to fans how all this happened. If they choose to burry their heads in the sand then it is not surprising that the fans get upset and perhaps confused about what is going on.

    That said we do want to lay out the facts as accurately as possible.

    The match is wrong! What is the dispute process?
    If you feel your video has been misidentified by the Video Identification system, you can dispute the identification. This involves filling out a short form listing the reason for your dispute. We then notify the content owner whose reference material was matched. The content owner will then review the match. If the content owner disagrees with your dispute for any reason, they will have the option to submit a copyright takedown notice which will result in the disabling of your video and/or penalties against your account. To avoid penalization, only submit legitimate dispute claims.

    If you dispute the claim made by Eqal it can result in "penalties against your account". I think we all know exactly what that means. Right? That would seem to be generally in line with what was written in the article which was fairly general in its terminology.

  39. I don't understand why the Creators are being blamed for any of this at all. Why is there always such hostility towards them?

    EQAL obviously is trying to protect their vids from people using them like thousands of other copyrighted vids. People post other people's videos as their own on YouTube all of the time.

    If in trying to protect their property from people like that, YouTube's filters pick up fanfic too, how is this in any way the Creators'/EQAL's fault?

    It isn't a very difficult concept to understand. We all know that the Creators have always encouraged and supported fan vids. And, since Amanda has ALREADY stated in so many words that they still feel the same way, and to keep making vids, why was the original post made in the first place?

    Without using the terminology that another poster has made, I'll just say that the original post, and many of the comments made here in support of it, are just plain wrong and hostile towards the Creators for very petty reasons.

    I don't think they will ever make a bunch of you happy, so I really have to wonder why you still watch, and why you even care -- just delete your videos and move on.

    If people have left, oh well. That this would be the reason shows they had no real desire to stay anyway.

    In addition, "I do not have a copy of the original e-mail so I cannot comment on the accuracy of the post" basically tells the community all it has to know. You cannot proof what your blog publishes because you don't know the facts in the first place. You don't know if anything in that post is true. And yet, you refuse to do the right thing and take it down until the question of accuracy has been settled.

    Blog: "How am I supposed to prove that? I don't have the notice!"

    I have told you before, I will gladly release my e-mail once you have done your part. If you are unable to verify the factual accuracy of this blog post, then clear it for the time being and place a note that the factual accuracy of it has been disputed. All of us can then take a look at the actual notice and see if anything in there supports the wild allegations made by LG15 Today.

    Quite frankly, it is a mystery to me how you can actually resist on this issue if I have already proven by double linkage that at least parts of the post are inaccurate, and you have no way of checking whether the rest is true.
    Even if you don't believe me at all, the very fact that you cannot fact check Ever's claims should be reason enough for you to temporarily take it down until the question of accuracy is settled.

    As for your latest post, that was also in my original post - do you actually dispute your are using material copyrighted by Eqal? As I have mentioned multiple times before, the allegation that YouTube alleges copyright infringement is false. It simply doesn't. It informs you that YouTube has identified that content as being owned by "lonelygirl15". And that is a fact. Or are you claiming you own the copyright to "Daniel's" ninja video footage?

    In addition, you conveniently ignore the fact that both YouTube's notice as well as Amanda here and on Inside have said that this notice should not be coming and they are trying to get it to be fixed.

    There is no legal threat. There is no allegation of infringement. You are creating a controversy where there is none.


    Are you going to continue defending this post even after admitting you cannot check whether it is true or not, or will you take it down for now?

  45. The anger comes from the fact that people entered a contest at the invitation of the Creators. Some of those who entered the competition were then issued notices from YouTube which accused them of using copyrighted material (which was in fact the entire purpose of the Eqal competition) because of the settings that Eqal had selected. Since Eqal has now done the right thing and changed the settings lets hope this problem has been resolved.

    However a number of fans were extremely upset and that is neither good for Eqal or the show. If this post highlighted the issue and aided in communication then it has served its purpose.

    All of this could have been avoided if Eqal had communicated with fans when they first raised this issue.

    As far as I can tell Amanda did not have a problem with the post and she has resolved the problem with YouTube so we can now all move on.

    None of what you just said justifies lies and slander, none of what you just said proves the factual accuracy of the original post, and none of what you just said changes that you are unable to verify the original post.

    I understand people are angry. But at least post and discuss the real reason they angry, don't invent a dozen other claims to make them more angry.

    You have a bunch of serious claims and allegation in your original post. I have provided links that prove several of them false, I have the proof to prove several more are false, and Amanda has just said there is no legal threat in the first place.

    WHAT DO YOU HAVE? What is your justification for keeping this post up despite the fact that it is evidently false and misleading?



    And for the record, I do notice your cheap attempt to quickly seal this now and weasel out of before having to explain to anyone why you post unverified slander on the blog.

    the creators have never been ANYTHING but supportive of fan videos, including parodies and spinoff series of all types. they deserve CREDIT for allowing this to occur and supporting it.

    with that background, they deserved the benefit of the doubt on this youtube thing, and amanda had already posted elsewhere that they were looking into it.

  50. I believe the reason that there was a post was that there was no follow up from Amanda. Hence no one was sure that the problem had been resolved and there was no way of knowing without publicly raising the issue. That said, it is great that the issue has been dealt with.

    Hopefully in the future Eqal will develop a more effective way of dealing with fan concerns but we do understand that at this time they are juggling a lot of balls.

    The c's have been incompetent with tech issues since Day One. That said, I doubt there is any malice intended towards the phans and it appears as though they are trying to address the issue.

    What's a shame is that they don't seem to have a handle on tech issues and blunder into these kind of phan alienation problems at every turn. Just because you show PowerPoint presentations to Valley Angels means you are technically competent, witness the lameO Shiny New Phorum.

    EQAL needs to spend the money on hiring a competent tech outfit and should stop trying to do this stuff themselves. They constantly phail.

    Now, if I have 6 of these saying that, and milo has the same one, probability is high all of them look like that.

    - YouTube alleges copyright infringement.
    - YouTube instructed milo to delete his videos, among other things.
    - YouTube threatened to remove his accounts as a reaction to that incident.
    - YouTube is offering him a choice about the action taken.
