  2. Copyright and Trademark (if you believe in such legal constructs) are a double edge sword. YouTube really had no option here if Summit made a claim.

    The real question is not whether or not it infringed but what motivated Summit to make such a move. But again, this just demonstrates that copyright can be used for GOOD, or it can be used for EVIL.

    You be the judge of how Summit used it here.

  3. Howdy folks,

    Here is what ya'll need to know. Part of the Safe Harbor provision which is what allows YouTube to basically still exist given all the copyright infringement that goes on there, requires that they have an automatic takedown procedure, which occurs expeditiously. In other words, if someone with even the barest of claims, claims infringement YouTube must take down. YouTube doesn't exist to fight copyright battles.

    The 'infringing party' then gets to fight it. A process which can get both messy and costly. In this instance, the Fine Bros probably have a strong argument under the parody defense. If they want to fight it they have a good argument. Although their best option is just to stick it up on DailyMotion, and not worry about fighting a fight unless they are planning to make money from the video in which case they need to weigh possible litigation costs vs potential profits.
